Occupier's Liability to Invitees and Licensees

This lesson focuses on the distinction between invitees and licensees, and the duty owed by an occupier to each category of entrant. It includes problems designed to test student understanding of the distinction between licensees and invitees, and to highlight the differences between the duties owed to each.

On completion of the lesson, students will be able to:

  1. Explain the difference between invitees and licensees
  2. Analyze the duty owed by an occupier to each category of entrant - invitee and licensee.
  3. Discuss why some states have abandoned the distinction between licensee and invitee and now treat both types of entrant in the same way.
