Limitation of UCC Remedies
Many sellers do not disclaim warranties, but give a warranty with a limited remedy. This lesson explores the usual limitations of remedy and the statutory restrictions on them.
Learning Outcomes
On completion of the lesson, the student should be able to:
- State the default rule for damages for breach of warranty.
- Recognize when a seller has given a limited remedy.
- Analyze whether a limited remedy has failed of its essential purpose.
- Distinguish between disclaimer of consequential damages in a commercial case and in a consumer case.
