Demurrers and Judgments on the Pleadings

This lesson has been revised to reflect the December 1, 2006 amendments to the Federal Rules of Civil Procedure, as they were re-written effective December 1, 2007.

The student is given sets of pleadings in civil cases and asked to identify issues that would be raised on a demurrer or motion for judgment on the pleadings. Although the case is set in a hypothetical code pleading state, the exercise also deals with motions to dismiss or for judgment on the pleadings under the Federal Rules of Civil Procedure.
